The three-man panel of the Presidential Election Petition Tribunal in Abuja has granted the People’s Democratic Party (PDP) permission to inspect all the electoral materials used in the February 23 presidential election.
People’s Democratic Party’s candidate in the presidential election, Atiku Abubakar filed an ex-parte motion at the Court of Appeal in Abuja, asking for various orders of the court to allow him to examine all documents used by the Independent National Electoral Commission (INEC) for the conduct of the presidential election.
The panel heard the ex-parte motion on Wednesday and have granted Atiku the requested access to all the materials used in the February 23 election.
The panel delivered its ruling, ordering the Independent National Electoral Commission (INEC) to grant Atiku access to all the electoral material used on February 23 to enable him to file and maintain an electoral petition.
Meanwhile, the court refused prayers 3 to 5 of Atiku’s ex-parte motion which sort scanning and forensic audit. The panel stated that a forensic audit does not fall under the terms envisaged by section 151 of the electoral act.
The panel constituted Justice Abdul Aboki as lead, and Justices Peter Ige and Emmanuel Agim.
They unanimously agreed to the ruling, hence, the motion was granted in part.
